Brutality on protestors condemned

Baba Ramdev's forceful eviction in New Delhi on Saturday night found its echo in the Karnataka legislature on Monday. A resolution was passed in both Houses condemning the Centre's act and seeking a high-level inquiry into the incident.

The discussion was initiated by labour minister B N Bachhe Gowda. State BJP president K S Eshwarappa termed the police action at Ramlila Maidan, where
Baba Ramdev was holding his protest, as "independent India's Jalianwala Bagh". He warned that the UPA government is playing with fire.

Chief minister B S Yeddyurappa termed the incident unpardonable and said the Congress had repeated the Emergency days. Holding the Centre responsible for the act, he called upon the people cutting across party lines to support the movement and make it a success.

In the legislative council, higher education minister V S Acharya moved the resolution and criticized the National Human Rights Commission for the delay in taking action.

Learn to respect policemen, else face the heat







After several instances of policemen being assaulted by members of the public were reported recently, city police commissioner Shankar M Bidari issued stern warnings, saying stringent action would be taken against those attacking his men.
But is that the best way to approach this problem? Is there some underlying problem of which the attacks are merely a symptom?

Home minister VS Acharya admitted, in an interview with DNA, that policemen too need training in dealing appropriately with the people they are meant to protect. Those misbehaving with police personnel, however, will get the ‘treatment’ they deserve, the home minister said.

What have you planned to bring those who attack policemen on duty to book? And how would you explain the recent spurt in such instances?

There need be no leniency shown to those who feel free to attack policemen on duty. We will take measures to ensure that such attacks do not happen. Most of the assaults have happened late in the night, and the attackers are mostly people driving home drunk, who have been hauled up. These are miscreants who ought to be taught to cooperate with police personnel who are only doing their duty. We’ll take strong action against them.

These incidents are cause for concern. Do you think they have an impact on the morale of the police force?

If people who attack policemen are let off easily, it would send out a message about the police force being bullied. People will begin to look with contempt at policemen if we fail to deal with these miscreants sternly. We cannot ignore such attacks, as it would be detrimental to the image and morale of the policemen.

Are you implying that the policemen are never at fault?
Policemen are not saints. They too are human and sometimes make mistakes. What I am saying is that all instances of attacks on our men in uniform will be scrutinised. Corrective measures will be taken.

Do you have a notion of what the solution to this problem might be?
There should, as far as possible, be no lapse on the part of the policemen. To train our men adequately, we will be bringing out miniature police diaries for people in each district. The diaries will contain phone numbers of police officials. If anyone faces harassment at the hands of a policeman, he or she should know how such misbehaviour could be reported, and the right channels through which action can be taken in such cases. Officers will be available on phone round-the-clock.

Has something like that ever been tried?
We launched an initiativein Dakshina Kannada. Soon, all districts will have it. We have also started orientation programmes for police personnel.

Are Karnataka's campuses the hotbed of Naxal sympathizers? "To some extent, yes,'' home minister V S Acharya maintained.

"There are reports of some Naxal sympathisers in universities and colleges of the state. As of now, I cannot reveal more details,'' he told in the council on Thursday.

Describing Naxalism as "hysteria'', Acharya said: "We should carefully curb the audience to Naxals similar to the hysteric treatment, I seek cooperation from all quarters in this regard.'' (TOI)

Karnataka: curbing a menace

Bangalore, June 22 (PTI): Karnataka was in the process of formulating a package for the benefit of Naxals who wish to surrender, Home Minister Dr V S Acharya said today.

"The new package is likely to be announced in about six months by the authorities in Naxal affected districts," he told reporters here.

He claimed Naxal activities in the state have come down due to steps taken by Karnataka in the last eight years.

Acharya regretted that Karnataka had not been invited to the recent meeting of Naxal-hit states convened by the Centre to discuss the problem despite the fact that the state has seen a decline in Naxalite activities.

The Anti-Naxal Force is engaged in regular combing operations in Naxal-affected districts, he said.

Investigating agency plans to book scribe who had shown visuals of officials questioning Nithyananda on TV
MS Raghavendra, producer of a daily crime programme that's broadcast on Udaya TV, had shown visuals of officials questioning the self-proclaimed godman in a chamber inside the CID head quarters. Raghavendra had procured (bought) the visuals that were recorded on CCTV camera from a source.

The investigating agency is planning to book him on charges that include conspiring against the state and data theft.

Home Minister Dr VS Acharya, on the other hand, admitted that the department is planning to book some journalists, including Raghavendra. "As a few of them have grown so impish, we have to put brakes on them," he said. The state Home Minister fired salvos against Raghavendra for his attacks on the system as a journalist. (MidDay/NDTV)

Police too have Human Rights!


As if fighting the Maoists was not enough, the police involved in the anti-Naxal operations in Chattisgarh are stretched on another front where they have to spend a considerable time in courts.

Police often get bogged down by cases of alleged human rights violations in various courts resulting in diversion of manpower affecting its operational capabilities in the operations in the Naxal-hit state, top police officers said today.

And the man worried is none other than Director General of Chhatisgarh Police Vishwa Ranjan who finds himself in a catch-22 situation as his men have to spend more time in courts with lawyers to counter the propaganda of Naxals which is being spread through human rights activists.

The case of Dantewada, the heart of Maoist insurgency, has been cited by the police to buttress their point.

The district Superintendent of Police Amresh Misra has to spend half his time in Delhi with lawyers in a Public Interest Litigation filed before the Supreme Court by a human rights activist Himanshu Kumar alleging that 13 people were killed in fake encounters.

In fact, all the 13 persons were alive and their statements have been recorded before a magistrate in a Delhi Court, says Ranjan.

"But to counter this (allegation), my SP has to spend most of the time in Delhi briefing lawyers," he told

Invite Human Rights groups to Police functions

Unscientific ‘killer’ road humps in the City are posing problems to the vehicle-riders, according to Home Minister V S Acharya.

Inaugurating the building of Mico Layout police station here on Tuesday, he said the road humps should be constructed more intelligently.

Praising Police, Acharya requested the police to invite organisations fighting for Human Rights to police functions, especially those on property recovery and distribution parades. By doing so, the minister said, these organisations will get to know the efforts and the turmoils of policemen. Several police officers in the rank of DCPs, ACPs, police inspectors and sub-inspectors from various divisions, excluding traffic, were rewarded on the occasion.

A booklet on junction plan for traffic signals in Bangalore City - version 1.0 was released on the occasion.

Justice Somashekara Commission Submits Interim Report




Mangalore, Feb 1: The Justice B K Somashekara Enquiry Commission set up to investigate the church attacks in the state, presented its interim report to the government on Monday February 1.

The Commission has made several suggestions and recommendations to the government to consider and implement.

The recommendations are:

Government should ensure protection to all religions and their institutions, particularly in the affected districts due to attacks and especially to minority religions and should be spelt out in clear terms without politicization.

As a first measure, the government should convince the affected Christian institutions and persons that it shares their miseries and sentiments suffered due to unpleasant incidents of attacks in all forms with sympathy, compassion, and concern by taking all the religions and political parties into confidence.

The district administration at all levels should be made liable for all violations in any form and extent of such protection.

A common modality should be framed and adopted for all the district administrations to deal with all situations of religious matters uniformly, impartially, effectively, and speedily.

The intelligence wing of the government, at least in all districts, must be geared up with trained personnel, infrastructure, headed by expertise and commitment to social and religious causes especially to deal with all situations of religious conflicts supervised and monitored at least by an officer of IGP cadre of the state.

The state should take all measures to ensure fundamental rights for freedom of conscience and free profession and propagation of religion within the meaning of Article 25 of the constitution of India in letter and spirit.

Religious harmony awareness programmes may be initiated at village and taluk levels to avoid unexpected religious conflicts with elders of all religions constituting the peace committees.

Legislations through special law within the competence of the state under lists of the constitution may be passed to ensure prevention of atrocities on any person in the name of religion in any form and protection of all persons claiming the privileges by virtue of a religion as per the law without reference to the conflicting legal consequences.

All communal organizations in whatever name or form preaching or practicing any activity against any religion in any form should be banned as per the law existing to be legislated with the serious consequences of forfeiting assets to the government free from all encumbrances.

All the materials in any form including literature, books, pamphlets, publications including the press and media in any form using abusive or insulting expressions either direct or with innuendos touching the religious interests should be banned if existing and censured if proposed to be published.

All criminal cases registered investigated or charge sheeted against all persons or institutions for the incidents of attacks etc, during the relevant period with cut out date ending 31 December, 2008 may be withdrawn or compounded as per law, however on any reasonable conditions including the plea of bargaining sentence and probationary measures depending upon the facts and circumstances of each case.

Compensation for all claims for damages to the property or injury to any person during the incidents and thereafter shall be inquired and paid within one month from the date of communication of the recommendation by the appropriate authorities like the deputy commissioner of the districts either pending or made within one month there from deducting any amount already paid as indicated in the report while dealing with petitions of each district.

There must be least or no policing regarding religious matters and to be handled with care and compassion by taking the religious leaders or heads into confidence and entry into any religious place by the police for any action should be totally with the permission or at least consultation with the religious persons in charge of the places.

The government should constitute a task force under the chairmanship of the commission with duly nominated members from the departments of the government to monitor and implement the recommendation of the commission.

All decisions taken by the government on the recommendations of the commission and implementation by the government may be published as far as possible. All other questions not covered by these recommendations will be provided in the next or final report.

Below are the extracts from the synopsis issued by the commission to the public.

In some incidents there were indications of self-infliction or collusion or make-believe methods to create evidence of attack on churches or places of worship to support such things in other districts or places.

There are indications of massive conversions to Christianity by circumstances and inducements but not by compulsion. Such conversions were only by faith and not of religion in legal or technical sense.

The attacks on the churches or places of worship has deeply affected the harmony between the members of Hindu and Christian religions and created suspicion in the minds of each other.

Strong impression is created that the members belonging to Bajarang Dal, Sri Rama Sene, and VHP etc. are mainly responsible for attacking churches or places of worship mainly in Mangalore and South Canara districts spreading to other districts and other parts of the state. Other so-called attacks were only make-believe.


Commission's move termed as breach of privilege

Home minister V S Acharya citing the Commission of Inquiries Act, said provisions in the said Act mandate a commission set up under the Act to submit its report to the state legislature. In this case, Acharya said, legislature means the Cabinet. "The report should have reached us in a sealed cover, deliberated in the Cabinet, which in turn would take a decision on making its contents public by placing it before the assembly," he said. (TOI)

zero-tolerance to violence from any quarter

Q If central forces start operations against Maoists, what implications do you see for Karnataka? A In our state, Naxal activity is on a very small scale. It is not like in some other states. Our state is also not included in the national list of Naxal-hit states. Even at a high-level meeting on Naxals, we were told it wasn't necessary for us to attend, as Karnataka was not considered a Naxal-affected state. I say it as home minister and please take that seriously.
What will be the state's policy on Naxals if the new offensive starts?
With or without central offensive, we have on our own been acting against Naxals. We are duty-bound to act against them. If we receive a circular on the new plans or any directions are issued, we will follow them.
What is your perception of the Centre's new plans?
Let the Centre be clear and firm in their policy. They should go the whole hog against Naxals or else the problem won't be solved. There seems to be dilly-dallying. One day, they say the military will be involved, the next day they retract. One day, they say IAF helicopters will be involved, the next day PM says no. What is this? Naxals can only be put down with a firm hand. The planned offensive against Naxals is good. Better late than never. But some states require more urgent assistance than we do.
Is Naxalism a serious problem in the state?
There isn't much Naxal activity in Karnataka, except for the occasional eruption of violence and death. It is restricted to a few pockets.
What is your view on `Naxal sympathisers'?
We are keeping a watch over them. We have even arrested some sympathisers, some of whom are tribals. Observation will continue.
Is the Naxal movement a development or law-and-order issue?
(Naxal activity &) Development is all nonsense. We will deal with it purely as a law-and-order issue.
Naxal movement doesn't have anything to do with social justice?
Nothing. Is killing innocent people social justice? They talk of high thoughts to camouflage bad deeds. We have zero-tolerance to violence from any quarter -- left-wing extremism or extortionists. India is a democracy and there are opportunities to protest in democratic ways. Violence has no place in a democracy.
How would you understand Naxalism?
Naxalism is a foolish, blind act. Madness. It is hysteria created by a group of misguided youth who don't have respect for law and democracy. I am a doctor and I would prescribe treatment to them. They have been struggling for 40 years and what have they achieved? A futile exercise. It has not reached, and will not reach, any logical conclusion. Some who have been arrested admit to us that it is all a wasted effort.
Any special development plans for Naxal-prone districts?
Some action is being taken. Local officials are looking into social and developmental issues so that no murmur crops up in the name of Naxal activity. We are trying to reach facilities to interior villages. The rural development minister has already visited some villages and action is under way.
Is backwardness related to Naxalism?
I am very clear -- we don't want to give the impression that it is due to backwardness that the Naxal movement has started. Facilities will be provided to all backward districts anyway.
How would you solve the Naxal issue in the long term?
We are very confident we will solve the issue soon. Our forces are on alert and are watching people involved in Naxal activity. There is absolutely no dearth of money or manpower. As home minister, I have to be clear -- you are with the law or you are not. If you are not with the law, I will have to act as per law.
Is the door shut on talks with Naxals?
The door is always open. If you don't knock on it to get an opportunity, what can we do? We have always said and I say even now, that if Naxals lay down weapons and come for talks, we will bring them back to the mainstream. We will rehabilitate them and give them an honourable living.

Police personnel too have Human Rights: Bidari




"Following assertions made by certain Congress leaders detained on Adugodi City Armed Reserve premises, clarifications have been issued to the public,"


*"The Congress didn't obtain licence from the police before its members went on a protest on Saturday morning,"


* 345 persons were detained for violating prohibitory orders and for attempting to lay siege to Vidhana Soudha. They were detained in the drill shed of the City Armed Reserve, Adugodi * Since 1982, this area has always been used as a detention centre. Agitating farmers, labourers, anganwadi workers and political activists have been detained at this place during protests * The area is a drill shed used for police functions. We have provided 300 chairs for persons detained on Saturday * They were given mineral water, tea and coffee. Lunch was arranged from Adiga's restaurant * The office room of DCP, headquarters, was vacated to accommodate detained leaders. Bathrooms at the DCP's office have been provided for all detained men and women * Two senior officers of DCP rank were looking after the well-being of detained persons from 11 am until their release at 5 pm * The detained were allowed to use mobile phones. No search was carried out on them * They were allowed to move freely within the vast area of CAR (south), Adugodi * The assertion that detained persons were kept at a dog shed is false. A signboard displaying `Police Dog Squad' was, incidentally, near the place of detention. Visuals that appeared in the electronic media also corroborate this fact. The height of a dog shed is 4 feet and the height of a conventional shed is minimum 16 feet * Police know that the detained are senior political leaders and activists. They have been treated with courtesy. (TOI)

BANGALORE: The legislative council debate on communal clashes in Mysore city was put off to Monday following a request from the ruling party leaders and acrimony over an adjournment notice from the opposition leader. " For God's sake lets not debate on this issue today as the situation is still tense in Mysore. The words we speak here may provoke the people there. We will first ensure the situation is under control and later we will answer all your queries,'' chief minister B S Yeddyurappa said in reply to the opposition leader's demand seeking to move an adjournment motion on the issue. The CM also maintained that local people in Mysore are not instigating the violence but vested interest from Kerala, Mangalore and Kodagu. "How will local people dare to indulge in violence when section 144 is in place? This is clearly the act of outsiders to disturb peace and harmony in the state,'' Yeddyurappa said. Defending the police, the CM said its high time they support the police and boost their morale. Earlier, acrimonious scenes were witnessed when the ruling party leaders including Yeddyurappa raised objection to contents in the notice of opposition leader V S Ugrappa seeking adjournment motion to debate on communal clashes in Mysore. While appealing for a debate on the issue, Ugrappa, in his notice, had held police and state government responsible for the clashes. Ban on CPI Maoist movement...when left is not on the right path...


State Home Minister V S Acharya on Monday welcomed the Centre’s decision to ban the CPI (Maoist), declaring ait as a terrorist organisation, reports DHNS from Bangalore.


“We welcome the Centre’s move. It will help the State to book cases against those involved in Naxalism under the Unlawful Activities Act. The Centre should have done it long ago,” he said. Acharya said the State Government would not only announce a package to rehabilitate surrendered Naxals but also come up with a development blueprint for the Maoist-affected regions of the state.Acharya told reporters that his government was in the process of finalising details of the package, which would end nearly two-decade-old Naxal menace in the State. He, however, refused to divulge details.The government wants to bring those involved in Naxal activities in to the mainstream and completely root out the menace from the State. “So far, the results have been very encouraging. Some of them (Naxalites) have already come forward to surrender,” he said.Asked whether the government would initiate legal proceedings against those who surrender, Acharya said he did not want to reveal any details about the package in the State’s interest. “We are on the verge of ending the Naxal movement and we are confident at this stage that it will be ended,” he added.Naxalism started in 1992 with the Appiko movement. Many members of the then Karnataka Vimochana Sangha turned into Naxalites. But unlike other Naxal-affected States, the movement did not get the peoples’ support. Karnakata was not in the list of seven Naxal-affected states, he said. (Deccan Herald)
